What is New York Probate or Administration?

Probate is the legal process of submitting to court for approval the will of someone who has passed away. The court validates the will and legally appoints the executor named under your will. An executor is responsible for carrying out the affairs of the estate, including collecting assets, paying debts, such as taxes, and distributing estate assets in accordance with the will.

Administration is the legal process that occurs when there is no will.  The next of kin or other heir is appointed by the Court to collect the assets, pay the debts and then distribute the remaining assets to the proper heirs at law.

My job as estate attorney is to simplify the probate process for the Executor or Administrator, deal with the Court, and obtain the appropriate paperwork to enable to the Executor or Administrator to collect the assets, pay the debts of the estate and then distribute the remaining assets to the beneficiaries or heirs.
